Parental rights of persons with disabilities in the light of the case law of the European Court of Human Rights

Celem niniejszej pracy jest analiza sytuacji prawnej rodziców z niepełnosprawnościami poprzez pryzmat orzecznictwa Europejskiego Trybunału Praw Człowieka. Orzecznictwo ETPC jest znaczące ze względu na możliwość przekrojowego zobrazowania poruszanej problematyki na terenie Europy oraz ze względu na swoje oddziaływanie na europejskie prawodawstwo. Pierwsza część pracy poświęcona jest przybliżeniu omawianej tematyki z punktu widzenia historii jak i obecnej sytuacji prawnej oraz przedstawieniu najistotniejszych pojęć i klasyfikacji.Główną część pracy stanowią trzy rozdziały skupione na omówieniu problematyki praw rodzicielskich osób niepełnosprawnych na przykładzie trzech różnych orzeczeń. Pierwsze orzeczenie pozwala na omówienie art.8 EKPC jako podstawy skargi oraz zwrócenie uwagi na praktykę i tendencję orzeczniczą ETPC w zakresie praw rodzicielskich osób z niepełnosprawnością. Druga skarga wprowadza problematykę dyskryminacji oraz art. 14 EKPC jako podstawy skarżenia. Trzecie orzeczenie obrazuje problematykę praw rodzicielskich osób niepełnosprawnych w Polsce oraz podkreśla aspekt pozytywnych obowiązków państwa wobec osób z niepełnosprawnością.

The aim of the thesis is the analyse of the legal situation of parents with disabilites through the prism of the case law of the European Court of Human Rights. The case law of the ECtHR is significant due to the fact that it gives the possibility to cross-cut illustrate the spectrum of the discussed matter and due to its influence on European legislation.The first part of the research is focused on introducing the discussed subject from the both, historical and current legal, perspectives. The main part of the thesis is the three chapters, that are focused on reviewing the subject of parental rights of persons with disabilities using three different judgments as examples. The first judgment allows to discuss the art. 8 ECHR as a legal base of the application and to emphasise the practices and trends of the ECtHR case law in the matter of parental rights of persons with disabilities. The second application introduces the topic of the discrimination and art. 14 ECHR as the legal base of the application. The third judgment illustrates the matter of parental rights of persons with disabilities in Poland and highlights the aspect of the positive obligations of the state towards the persons with disabilities.
