Human Rights Crisis in Mexico in the 21st Century

Praca magisterska porusza temat kryzysu praw człowieka, który ma miejsce w Meksyku w XXI wieku ze szczególnym uwzględnieniem okresu od 2006 roku. Kryzys ten charakteryzuje się powszechną przemocą i brakiem bezpieczeństwa, a jego skutki dotykają w sposób szczególny biedną część społeczeństwa. Ponadto w wyniku bezkarności naruszycieli praw człowieka cierpią migranci, osoby ubiegające się o azyl, uchodźcy, kobiety, nieletni, obrońcy praw człowieka, dziennikarze, ludność tubylcza oraz członkowie mniejszości seksualnych.Celem jest analiza i wykazanie skali problemu naruszeń praw człowieka w Meksyku w XXI wieku, zarówno pod względem ilości oraz zasięgu jaki obejmują te działania. Ponadto przegląd podmiotów sprawczych owych aktów, ich motywów oraz realizacji działań ochronnych przez władze państwowe, mają doprowadzić autora do odpowiedzi na pytanie czy istotnie sytuacja praw człowieka w Meksyku jest aż tak poważna,a jeśli tak, to dlaczego zarządzający krajem zawodzą w istotnej i podstawowej kwestii jaką jest zapewnienie bezpieczeństwa i ochrona praw swoich obywateli.Praca składa się z czterech rozdziałów, które odpowiednio przybliżają problematykę łamania praw człowieka w kraju. Najpierw poruszono podstawy problematyki paradygmatu praw człowieka, jego podziału, teorii i podstawowych dokumentów, na bazie których w dalszej części pracy analizowany jest przypadek Meksyku. Została tu poruszona również kwestia systemu ochrony praw człowieka w regionie amerykańskim, a także kwestia praw człowieka w problematyce stosunków międzynarodowych, Kolejny rozdział opisuje kryzys przestrzegania praw człowieka w kraju. Przywołane tu zostały przyczyny owej sytuacji w kraju, a kolejno poddane analizie i charakterystyce zostają poszczególne naruszenia praw człowieka. Są to: przemoc wobec kobiet i dziewcząt, prawa uchodźców i migrantów, wymuszone zaginięcia i porwania, tortury i inne formy złego traktowania, przemoc związana z przestępczością zorganizowaną, prawo do wolności słowa oraz grupa innych nadużyć dotyczących praw ludności rdzennej czy prawa do wolności zgromadzeń. Dalsza część stanowi podsumowanie działań organizacji międzyrządowych, międzynarodowych oraz krajowych zajmujących się ochroną praw człowieka, a czwarty rozdział jest próbą odpowiedzi na pytanie jaka przyszłość czeka prawa człowieka w Meksyku na podstawie przeanalizowanych raportów. Dodatkowo zawarto tu najważniejsze rekomendacje międzynarodowych i narodowych organizacji dotyczące zmiany polityki władz meksykańskich odnośnie problemu naruszania praw człowieka w kraju.

This paper treats about the human rights crisis occurring in Mexico in the 21st century, with special respect to the period from 2006 to 2018. This crisis is marked by the widespread violence and the lack of security which especially affects the poorest segments of the society. Furthermore, perpetrators’ impunity results in the suffering of multiple groups including: migrants, asylum seekers, refugees, women, minors, human rights defenders, journalists, indigenous people, and members of sexual minorities. The main aim of this work is to analyze and demonstrate the scale of the problem of the human rights violations in Mexico in the 21st century, both in terms of the magnitude and the scope of these activities. Moreover, the review of the perpetrators, their motives, and the implementation of the protective measures by the state authorities will help to answer the question of the severity of these violations. Thus, explain why the state authorities fail in such a crucial and fundamental issue, which is to guarantee the security and protect the rights of its citizens. The paper consists of four chapters, which bring focus to different aspects of the human rights violations in this country. The first chapter shows the basis of the human rights paradigm, its division, theories, and crucial documents necessary for the further analysis. Furthermore, the chapter discusses the system of human rights protection in the American region, as well as the importance of human rights for the international relations. The next chapter describes the problem of human rights crisis in Mexico. It focuses on the potential causes of this situation, as well as all each specific types of the human rights violations. These include: violence against women and girls, rights of refugees and migrants, forced disappearances and kidnappings, tortures and other forms of ill-treatment, violence linked to the organized crime, freedom of expression and other forms of violations linked to the indigenous people, or the right to the freedom of assembly. The third chapter summarizes the actions of the intergovernmental, international, and national organizations that protect the human rights. Finally, the last chapter is an attempt to answer the question about the future of the human rights in Mexico on the basis of the analyzed reports. Moreover, it includes the most important recommendations of the national and international organizations regarding necessary changes of the Mexican authorities’ policy linked to the violations of human rights in this country.
