Copyright: challenges and prospects in the context of the development of the internet and technical progress

Celem niniejszej pracy jest analiza prawa autorskiego w relacji do rozwoju Internetu i postępu technicznego. Skontrastowanie „tradycyjnych” zasad systemu ochrony praw autorskich z wyzwaniami spowodowanymi przez rozwój sieci internetowej jest okazją do refleksji na temat ogólnego stanu ochrony praw autorskich we współczesnych społeczeństwach. Prawodawcy muszą bowiem nieustannie reagować na wyzwania będące wynikiem pojawiania się nowych sposobów korzystania z chronionych dóbr kultury za pośrednictwem Internetu.Pierwszy rozdział przedstawia wybrane akty prawa międzynarodowego, które miały decydujace znaczenie w kształtowaniu obecnego systemu prawa autorskiego. Drugi rozdział skupia się na podstawowych zagadnieniach prawa autorskiego, zarysowując problemy interpretacyjne wynikające z prób dostosowania obowiązującego prawa do możliwości oferowanych użytkownikom Internetu przez nowe technologie. Ostatni rozdział prezentuje wybrane kwestie dotyczące wpływu Internetu i nowych technik tworzenia, rozpowszechniania i kopiowania utworów na prawo autorskie. Przykłady te ukazują skalę przeobrażeń jakie Internet i nowe technologie wprowadzają do systemu prawa autorskiego.

The aim of this thesis is to analyze the copyright in relation to the development of the Internet and technological progress. Contrasting the "traditional" rules of copyright with the challenges posed by the development of the Internet is an opportunity to reflect on the general state of copyright protection in modern societies. Legislators are trying to respond to the challenges resulting from the emergence of new ways of using the protected cultural goods via the Internet.The first chapter presents selected acts of international law, which were essential in shaping the current copyright system. The second chapter focuses on the main notions of copyright, outlining the problems of interpretation arising from attempts to accommodate the existing system of copyright to the opportunities offered by the Internet and new technologies. The final chapter presents selected issues concerning the impact of the Internet and new techniques of creating, distributing and copying works on the present copyright system. These examples demonstrate the extent of transformation that the Internet and new technologies bring to the copyright system.
