Na podstawie moich rozważań, tekstów literatury i orzecznictwa krajowego, dochodzę do następujących wniosków. Ochrona GUI na podstawie pr.aut jest możliwa w dwojaki sposób. Elementy techniczne i użytkowe interfejsu w zakresie w jakim zostają wyrażone w kodzie źródłowym programu komputerowego mogą być chronione na podstawie przepisów szczególnych pr.aut. dotyczących ochrony programów komputerowych. Natomiast elementy interfejsu posiadające charakter graficzny, spełniające ustawowe przesłanki ochrony utworów, a także jego poszczególne elementy posiadające wartość estetyczną podlegają ochronie prawnoautorskiej jako utwory.
On the basis of my considerations, the texts of literature and national case-law, I come to the following conclusions. The GUI protection based on pr.aut is possible in two ways. The technical and functional elements of the interface, to the extent they are expressed in the source code of a computer program, can be protected on the basis of specific provisions of the license. regarding the protection of computer programs. On the other hand, elements of the interface that have a graphic character, meet the statutory prerequisites for the protection of works, as well as its individual elements having an aesthetic value are subject to copyright protection as works.
