Problems of protection of cultural heritage in the context of the market and the looting of works of art in Poland, with particular emphasis on the period after 1989.

Celem pracy jest wskazanie problemów ochrony dóbr kultury w kontekście przekształcającego się po roku 1989 rynku sztuki w Polsce. Aby w pełni przybliżyć kwestie dotyczące ochrony dóbr kultury praca składa się z trzech części. Pierwsza część (rozdział I) zawiera historię polskiego rynku sztuki, druga (rozdziały II-III) przedstawia analizę zagadnień teoretycznych oraz aktów prawnych obowiązujących przed i po 1989 dotyczących ochrony dóbr kultury. Trzecia natomiast (rozdziały IV-V) opisuje najbardziej kluczowe problemy wraz z działaniami podejmowanymi w celu lepszej ochrony różnorodnych dóbr kultury oraz rewindykacji dóbr utraconych. Najważniejszym zagadnieniem omówionym w pracy jest sytuacja prawna. Zagadnienie to nie zostało dotychczas przedstawione w literaturze kompleksowo. Zestawienie obecnych ustaw i rozporządzeń prawnych określających zasady ochrony dóbr kultury wskaże, iż funkcjonujący system prawny jest niewystarczający. Ukazanie i analiza problemów rynku sztuki na podstawie niepełnych dokumentów prawnych, pozwoli na przedstawienie narastających przestępstw przeciwko dobrom kultury.

The aim of the study is to identify the problems of protection of cultural property in the context of converting the 1989 art market in Poland. To fully bring issues concerning the protection of cultural work consists of three parts. The first part (Chapter I) contains the history of Polish art market, the second (Chapters II-III) presents an analysis of theoretical issues and legislation in force before and after 1989 on the protection of cultural property. While the third (Chapters IV-V) describes the most critical issues along with measures to better protect a variety of cultural and recovery of lost goods.The most important issue discussed in the paper is the legal situation. This issue has not been previously reported in the literature comprehensively. Summary of current laws and regulations of the regulatory principles of the protection of cultural property indicates that a functioning legal system is insufficient. Presenting and analyzing the problems of the art market on the basis of incomplete legal documents, will show increasing crimes against cultural property.
