Contemporary humanitarian operations in international law

Praca dokonuje analizy i charakterystyki aspektów prawnych związanych z użyciem siły w stosunkach międzynarodowych. Wyjaśnia znaczenie podstawowej terminologii związanej z omawianym zagadnieniem takich jak: zagrożenie dla międzynarodowego pokoju i bezpieczeństwa, agresja, napastnik, napaść zbrojna. Przedstawione zostały akty prawne regulujące prawo do użycia siły zbrojnej, w szczególności Karta Narodów Zjednoczonych, oraz dopuszczalne przypadki użycia siły zbrojnej. Omówiono warunki i kontrowersje związane z interwencją humanitarną. W pracy dokonano studiów nad dwoma przypadkami historycznymi: operacją humanitarną w Bośni i Hercegowinie oraz interwencją NATO w Kosowie. Odnośnie operacji w Bośni celem pracy było wykazanie przyczyn fiaska tej operacji. W kwestii Kosowa autor dokonał analizy stanu prawnego oraz przesłanek dotyczących legalności i konieczności interwencji, w wyniku czego udowodnił nielegalność interwencji w świetle prawa międzynarodowego. W obrębie zainteresowania pracy znalazły się również kwestie związane ze współczesnymi wyzwaniami dotyczącymi prawa do użycia siły zbrojnej takie jak: ewolucja charakteru konfliktów zbrojnych, naruszenie integralności terytorialnej państwa, terroryzm, zagadnienie broni masowego rażenia oraz państw upadłych.

This essay contains analysis and characteristics of the legal aspects related to the use of force in international relations. It explains the meaning of basic terminology, related to the discussed issue, such as a threat to international peace and security, aggression, attacker, armed assault. There are presented legal acts, regulating the right to use military force, especially the United Nations Charter and the permissible cases of use of armed force. There are described conditions and the controversies associated with humanitarian intervention. The paper presents two historical cases: humanitarian operation in Bosnia and Herzegovina and NATO’s intervention in Kosovo. Regarding the operation in Bosnia, the aim of the study was to demonstrate the reasons behind its’ failure. In case of Kosovo, the author analyzed the legal status and conditions related to the legality and necessity of the intervention. The result of the analysis was, that it was illegal according to the international law. Within the study interest, there were also issues related to contemporary challenges, regarding the right to use military force such as: the evolution of the nature of armed conflict, violation of territorial integrity of the state and terrorism, the issue of weapons of mass destruction and failed states.
