Celem artykułu jest przeanalizowanie roli prekluzji w postępowaniu polubownym pod kątem jej skuteczności w przeciwdziałaniu przewlekłości postępowania. W tym celu przeanalizowano rozwiązania ustawowe, jak i ewolucję podejścia do prekluzji w regulaminach największych polskich sądów polubownych, a także zebrano wypowiedzi doktryny w tej materii.
Abstract in English
The aim of this article is to analyze the role of preclusion in arbitration proceedings in terms of its effectiveness in counteracting the lengthiness of proceedings. For this purpose, the statutory solutions as well as the evolution of the approach to preclusion in the rules of the largest arbitral tribunals were analyzed, and the statements of the doctrine on the subject were collected.
