Uznanie tytułu rdzennego na przykładzie Australii. Case study orzeczenia Mabo v Queensland (No. 2).

W Australii dla społeczności rdzennych szczególnie ważne było utrzymanie związku z zajmowaną przez nich ziemią. Wraz z kolonizacją i masowymi przesiedleniami wiele społeczności jednak utraciło ten związek. Dlatego w centrum walki o poszanowanie należnych im praw, wielokrotnie ignorowanych i łamanych, było prawo do ziemi. Dopiero ponad 200 lat po rozpoczęciu kolonizacji Australii, w 1992 roku, tradycyjne prawa do ziemi zostały uznane w formie tytułu rdzennego przez Sąd Najwyższy w orzeczeniu Mabo v Queensland. Głównym celem pracy będzie przybliżenie procesu uznania praw ludności rdzennej w Australii poprzez analizę orzeczenia Mabo z 1992 roku. Zwrócona zostanie uwaga na argumentację dotyczącą odrzucenia doktryny terra nullius oraz na ile uznanie tytułu mogło mieć znaczenie dla ludności rdzennej poprzez wskazanie i ocenę ograniczeń tego tytułu.
It was very important for indigenous peoples in Australia to maintain a connection to land they occuppied. However most of indigenous communities lost this connection because of colonization and mass displacement. Therefore, land rights were at the centre of struggle for their rights, which were repeatedly ignored and violated. More than 200 years after the colonization of Australia began, in 1992, indigenous peoples’ traditional land rights were recognized as native title by the High Court in Mabo v Queensland. The main purpose of this thesis is to present the process of recognizing traditional rights in Australia by analyzing the Mabo decision from 1992. Special attention will be paid to the arguments regarding the rejection of the doctrine of terra nullius and to what extent the recognition of native title could have been significant for the indigenous peoples by indicating and assessing its limitations.
