Evolution of the status of the International Committee of the Red Cross under international law

Praca poświęcona jest historii i ewolucji statusu Międzynarodowego Komitetu Czerwonego Krzyża z perspektywy prawa międzynarodowego. Prześledzone są w niej wydarzenia historyczne związane z Komitetem od momentu jego powstania w 1863 r. do dnia dzisiejszego, ze szczególnym uwzględnieniem działalności tej instytucji w okresie obu wojen światowych. Równolegle przeanalizowany został rozwój statusu prawnego Komitetu, zarówno z perspektywy szwajcarskiego prawa prywatnego, jak i prawa międzynarodowego. Szczególna uwaga poświęcona została kwestii podmiotowości międzynarodowej Komitetu, którego status jest wyjątkowy na tle pozostałych aktorów prawa międzynarodowego. W tekście prześledzone zostały prace organizowanych przez Komitet i Ruch Międzynarodowego Czerwonego Krzyża konferencji, które przyczyniły się do rozwoju międzynarodowego prawa humanitarnego, a także szeroko pojętego Czerwonego Krzyża. W końcowej części pracy opisane zostały: obecny status Komitetu, jego aktualna działalność, a także rola jaką pełni współcześnie w Ruchu Międzynarodowego Czerwonego Krzyża i Czerwonego Półksiężyca.

This work is about history and evolution of the status of the International Committee of the Red Cross under international law. It follows the historical events concerning the Committee from the moment of its creation to the present day, especially the events that took place during the world wars period. The development of the legal status of the Committee has been analysed from the perspective of the domestic Swiss law, as well as the perspective of the of the international law. In particular the subject of international legal personality of the Committee has been examined. This thesis also follows the works of international conferences organized by the Committee and the Red Cross Movement, which made a considerable impact on the development of the international humanitarian law. The current status of the Committee, its contemporary activity and its role within the International Red Cross and the Red Crescent Movement have been described in the final part of this work.
