The institution of the commencement of the use of a construction object in the light of doctrine and court jurisdiction

W pracy podjęto rozważania nad instytucją przystąpienia do użytkowania obiektu budowlanego, która jest prawnym instrumentem zabezpieczającym realizację decyzji o pozwoleniu na budowę i potwierdza prawidłowość realizacji obiektu budowlanego. W pracy przedstawiono sposób uregulowania przystąpienia do użytkowania obiektu budowlanego z uwzględnieniem jego usystematyzowanej formy prawnej, w szczególności poprzez uwydatnienie dwóch możliwych sposobów przystąpienia do użytkowania obiektu budowlanego. Dokonano analizy instytucji zawiadomienia o zakończeniu budowy oraz instytucji decyzji o pozwoleniu na użytkowanie, z uwzględnieniem ich różnic. Każdy z tych sposobów został przedstawiony poprzez wyodrębnienie aspektów podmiotowych, przedmiotowych i procesowych. Ponadto w pracy ukazano również możliwe warianty ich rozstrzygnięć. W ostatnim rozdziale przedstawiono aspekt podmiotowy, przedmiotowy oraz procesowy nielegalnego użytkowania obiektu budowlanego oraz omówiono skutki samowoli użytkowej.

The thesis considers the institution of the commencement of the use of a construction object, which is a legal instrument that ensures the enforcement of the construction permit decision and confirms the correctness of the construction object execution. The thesis outlines the regulatory framework governing the accession to use of a construction object, with regard to its systematized legal form, in particular by emphasizing two possible ways of accession to use of a construction object. The analysis of the institution of the notice of construction completion and the institution of the structure occupancy permit was conducted, including their differences. Each of these methods was presented by distinguishing the aspects of subject, object and process. In addition, the thesis also presents possible variants of their resolution. In the last chapter, the subject, object and process aspects of the illegal use of a construction object, along with its consequences, are elaborated.
