Cohabitation in the Polish law and the law of the Church

Praca magisterska przedstawia problematykę konkubinatu w zakresie dwóch porządków prawa, a mianowicie w prawie polskim oraz kościelnym. Praca składa się z trzech rozdziałów. W pierwszym rozdziale przedstawiona została historia konkubinatu, która swoim zasięgiem sięga wstecz po rozwiązania z prawa rzymskiego. Opisana także została problematyka konkubinatu na przestrzeni wieków w Polsce. Rozdział drugi ujmuje zagadnienia dotyczące konkubinatu we współczesnym prawie polskim. Rozdział ten przedstawia wyjaśnienie pojęcia konkubinatu w systemie prawnym oraz przedstawione zostały rodzaje wolnych związków. W rozdziale tym, problematyka konkubinatu została rozważona w oparciu o gałęzie prawa cywilnego, między innymi prawa rodzinnego, spadkowego, zobowiązaniowego. Rozdział trzeci obejmuje zagadnienie konkubinatu w prawie i nauczaniu kościelnym. Przedstawiona została problematyka konkubinatu w przed kodeksowym prawie kanonicznym. Natomiast druga część tego rozdziału poświęcona została tematyce konkubinatu we współczesnym prawie i nauczaniu Kościoła Katolickiego. Przedstawione zostało również podejście Kościoła do wolnych związków, a także skutki kanoniczne i społeczne tychże związków.

This master's thesis presents problems of the concubinage within the range of two orders of law, Polish legal system and Church principles. The thesis consists of three chapters. The first chapter presents the history of the concubinage which reaches for solutions from the Roman law. Also describes the problems of concubinage over the centuries in Poland. The second chapter describes issues concerning of the concubinage in modern Polish law and explains concepts of the concubinage in the legal system and presents different types of cohabitants. In this chapter, problems of the concubinage were considered based on such fields of civil law as, the family law, the law of succession and liabilities.The third chapter includes the issue of the concubinage in the system of law and church education especially problematic aspects of the concubinage in pre-of code canonical law.The second part of this chapter devoted to the subject of the concubinage in modern law and education of Catholic Church in particularly the approach of the church to cohabitants, and also canonical and social effects of these relationships.
