The Internet and the fields of exploitation of works

Niniejsza praca dyplomowa stanowi analizę wpływu Internetu na prawnoautorską regulację pól eksploatacji utworów. W jej treści przedstawiono zagadnienia teoretyczne dotyczące, m.in genezy, sposobu regulacji, zakresu, wyodrębnienia pól eksploatacji na gruncie ustawy z dnia 4 lutego 1994 roku o prawie autorskim i prawach pokrewnych. Następnie przywołano prawodawstwo europejskie, które powstało jako reakcja na rozwój nowoczesnych technologii komunikacyjnych oraz informacyjnych, a także jego stosunek do krajowego prawa autorskiego (w szczególności do katalogu zawartego w art. 50 pr. aut.). W dalszej części pracy przedstawiono funkcjonujące, za sprawą Internetu, sposoby wykorzystania utworów, jak również zbadano, czy znajdują do nich zastosowanie istniejące pola eksploatacji bądź konieczne jest wyodrębnienie nowych pól eksploatacji, które nie są objęte istniejącym obecnie katalogiem ustawowym.

This thesis is an analysis of the impact of the Internet on the legal regulation of fields of exploitation of works. The theoretical issues concerning, among others, the genesis, method of regulation, scope, separation of fields of exploitation on the basis of the Act of 4 February 1994 on copyright and related rights are presented. Then, European legislation, which was developed as a reaction to the development of modern communication and information technologies, was referred to, as well as its relation to the domestic copyright law (in particular to the catalogue contained in Article 50 of the Copyright Act). The further part of the work presents the ways in which works may be used thanks to the Internet and examines whether the existing fields of exploitation are applicable to them or whether it is necessary to distinguish new fields of exploitation, which are not covered by the existing statutory catalogue.
