Acceptance of a murder order under Article 148a § 1 of the Polish Criminal Code as a thoughtcrime

Artykuł dotyczy typu przestępstwa z art. 148a § 1 Kodeksu karnego dodanego na mocy ustawy z 7.7.2022 r. o zmianie ustawy - Kodeks karny oraz niektórych innych ustaw, który polega na przyjęciu zlecenia zabójstwa człowieka w zamian za udzieloną lub obiecaną korzyść majątkową lub osobistą. Analiza obejmuje warianty interpretacyjne art. 148a § 1 Kodeksu karnego, których kształt odnosi się do elementów karalnego przygotowania do zabójstwa z art. 148 § 5 Kodeksu karnego. Typ przestępstwa z art. 148a § 1 Kodeksu karnego wprowadza karalność "przedprzygotowania" do zabójstwa polegającego na powzięciu zamiaru przyjęcia zlecenia zabójstwa. Wyprowadzone wnioski pozwalają na rozstrzygnięcie charakteru prawnego przestępstwa z art. 148a § 1 Kodeksu karnego, który kryminalizuje powzięcie zamiaru popełnienia czynu zabronionego, a nie czyn zabroniony, dlatego jest swego rodzaju myślozbrodnią, co godzi w podstawowe zasady ponoszenia odpowiedzialności karnej.

The article concerns the type of crime under Article 148a § 1 of the Polish Criminal Code added by the Act of 7/7/2022 amending the Act - Polish Criminal Code and certain other acts, which consists in accepting an order to murder a human in exchange for a material or personal benefit provided or promised. The analysis includes interpretative variants of Article 148a § 1 of the Polish Criminal Code, the form of which refers to the elements of punishable preparation for murder under Article 148 § 5 of the Polish Criminal Code. The type of crime under Article 148a § 1 of the Polish Criminal Code introduces the punishability of 'pre-preparation' for murder consisting in the intent to accept a murder order. The conclusions drawn make it possible to resolve the legal nature of the crime under Article 148a § 1 of the Polish Criminal Code, which criminalises the intent to commit a prohibited act, not a prohibited act itself, is therefore a kind of thoughtcrime, which violates the basic principles of criminal liability.
