Administrative Judiciary in the Duchy of Warsaw

Niniejsza praca magisterska poświęcona jest zagadnieniom sądownictwa administracyjnego w Księstwie Warszawskim. Przedstawia podobieństwa i różnice instytucji sądownictwa administracyjnego w Księstwie Warszawskim do Francji. Ukazuje rozwój i kształtowanie się struktur sądownictwa administracyjnego w epoce napoleońskiej. Rozdział pierwszy zawiera charakterystykę Księstwa Warszawskiego. Ukazuje rozwój terytorialny i gospodarczy kraju oraz podział i organizację władzy państwowej Księstwa Warszawskiego. Rozdział drugi przedstawia charakterystykę sądownictwa administracyjnego sprawowaną przez organy pierwszej instancji. Opisuje skład, zakres kompetencji oraz zasady postępowania przed radą prefekturalną. Rozdział trzeci poświęcony jest Radzie Stanu, sprawującej funkcję organu drugiej instancji sądownictwa administracyjnego. Ukazuje charakterystykę rady pod względem powierzonych jej spraw z zakresu sporów administracyjnych. Opisuje tryb postępowania oraz zasady organizacji sądu drugiej instancji.

This Master’s thesis focuses on issues related to the administrative judiciary in the Duchy of Warsaw. It presents similarities and differences of the institution of administrative judiciary in the Duchy of Warsaw compared to France. It describes the development of administrative judiciary in the Napoleonic era. Chapter I focuses on the characteristics of the Duchy of Warsaw. It presents the territorial and economic development of the country and the division and organisation of the public authorities of the Duchy of Warsaw. Chapter II describes the features of administrative judiciary of the first instance. It describes the composition, powers and rules of conduct applicable to the prefecture council. Chapter III is devoted to the State Council, functioning as the administrative judiciary authority of the second instance. It describes the council in terms of the cases it handled in the area of administrative disputes. It also describes the mode of proceeding and the organisational rules of the court of the second instance.
