The cult of relics in the tradition and legislation of the Roman Catholic Church in reference to regulations of Polish law concerning human corpses and remains

Praca ma na celu systematyzację zagadnień dotyczących kultu relikwii w tradycji i prawodawstwie Kościoła Rzymskokatolickiego oraz regulacji polskiego prawa świeckiego odnoszących się do kwestii ochrony prawnej i postępowania ze zwłokami oraz szczątkami ludzkimi.Przedstawiono zmiany, jakie zaszły w postrzeganiu kultu świętych i relikwii na przestrzeni wieków oraz podjęto próbę zidentyfikowania czynników warunkujących społeczny odbiór omawianej formy pobożności rozwijającej się w Kościele Rzymskokatolickim. Nakreślone tło historyczne posłużyło jako wprowadzenie do analizy obecnie obowiązującego prawodawstwa Kościoła regulującego kult świętych i relikwii.Kolejno dokonano przeglądu przepisów polskiego prawa gwarantujących ochronę godności zwłok i szczątków ludzkich, a także regulacji związanych z czynnościami technicznymi, jakim poddawane są zwłoki i szczątki ludzkie, m.in ich przewożeniem, przechowywaniem oraz eksponowaniem w miejscach publicznych. Przeprowadzone rozważania pozwoliły dostrzec rozwiązania porównywalne oraz obszary rozbieżne pomiędzy dwoma badanymi porządkami prawnymi i sformułować propozycje zmian uzupełniających obowiązujący stan prawny.

The aim of the work is to systematize issues related to the cult of relics in the tradition and legislation of the Roman Catholic Church and the regulations of Polish secular law relating to the issue of legal protection and dealing with human corpses and remains.The changes that took place in the perception of the cult of saints and relics over the centuries and the identification of factors conditioning the social perception of the discussed form of piety developing in the Roman Catholic Church were presented. The outlined historical background served as an introduction to the analysis of the current legislation of the Church regulating the cult of saints and relics.Subsequently, the provisions of Polish law that guarantee the protection of the dignity of the body were reviewed and human remains, as well as technical regulations related to technical activities to which the corpse (remains) are subjected, including their transport and storage or display in public places.The conducted considerations allowed to notice comparable solutions and divergent areas between the two analyzed legal orders and to formulate proposals for changes supplementing the current legal status.
