Praca magisterska stawia sobie za zadanie znalezienie satysfakcjonującej i kompleksowej odpowiedzi na pytanie, czy dopuszczalnym jest zaistnienie zbiegu pomiędzy przepisami art. 284 k.k. oraz art. 296 k.k.. Pierwszy rozdział odnosi się do zagadnień teoretycznych dotyczących zbiegów. W rozdziale drugim przedstawione oraz poddane stosownej ocenie i reinterpretacji zostały skonsolidowane poglądy doktryny i orzecznictwa na temat możliwości zaistnienia zbiegu pomiędzy art. 284 k.k. oraz 296 k.k. Opracowanie kończy rozdział poświęcony analizie konkretnych przykładów wraz z proponowanymi sposobami ich rozstrzygania.
The master's thesis is to find a satisfactory and comprehensive answer to the question whether it is permissible for a concurrence between the provisions of articles 284 and 296 under Polish Penal Code. The first chapter deals with the theoretical issues concerning the concurrence of provisions. The second chapter discusses the views of doctrine and jurisprudence on the possibility of a concurrence between mentioned articles 284 and 296. The study ends with a chapter devoted to the analysis of specific examples along with the proposed ways to resolve them.
