On the statute of limitations in Polish criminal law

Głównym celem niniejszego artykułu jest analiza oraz ocena niektórych najważniejszych konsekwencji modyfikacji wprowadzonych przez ustawodawcę w zakresie konstrukcji przedawnienia karalności w ostatnim czasie, a także odniesienie się pokrótce do tych dopiero planowanych. Istotnymi problemami, nad którymi warto się tutaj zastanowić, są między innymi odpowiedzi na pytania: czy rzeczywistych powodów, których rozwiązanie mogłyby doprowadzić do zmniejszenia liczby przedawnień karalności czynów zabronionych należałoby poszukiwać tylko w treści przepisów prawa karnego, czy może są jeszcze inne konkretne tego przyczyny, a jeśli tak, to jakie?; czy aktualnie obowiązujące terminy przedawnienia karalności się wystarczająco długie, żeby sprawnie zakończyć postępowanie przed ich upływem?; czy zmiana wprowadzona przez ustawodawcę w ramach art. 102 k.k., dotycząca zarówno wydłużenia terminu przedłużenia okresu przedawnienia karalności przestępstw, jak i sposobu określenia przez ustawodawcę momentu pozwalającego na takie przedłużenie, jest rozwiązaniem właściwym? Należy więc zauważyć, iż w ramach tej problematyki istnieje wiele kwestii spornych, wywołujących od lat kontrowersje wśród przedstawicieli polskiej nauki prawa karnego, które warte są pogłębionych rozważań.

The main purpose of this article is to analyze and evaluate some of the most important consequences of the modifications introduced by the legislator in the scope of the statute of limitations recently, as well as to refer briefly to those planned. Important issues that are worth considering here include, among others, the answer to the following questions: are there real reasons, the solution of which could lead to a reduction in the number of statute of limitations, inter alia, the punishability of prohibited acts should be sought only in the content of the provisions of criminal law, or are there other specific reasons for this, and if so, what are they? Are the currently applicable limitation periods for criminal records sufficiently long to efficiently complete the proceedings before their expiry? Whether the change introduced by the legislator under Art. 102 of the Penal Code is the appropriate solution regarding both the extension of the period for extending the limitation period for crimes and the method of determining by the legislator the moment allowing for such an extension? It should therefore be noted that there are many contentious issues within this issue, which have been causing controversy for many years among representatives of the Polish criminal law science, which are worth in-depth considerations.
