The restitution of expropriated real estate - legal conditions

Tematem pracy magisterskiej jest analiza przesłanek zwrotu wywłaszczonej nieruchomości. Pierwszy rozdział omawia zakres pojęcia "wywłaszczonej nieruchomości" w celu określenia katalogu nieruchomości wywłaszczonych, które mogą podlegać instytucji zwrotu. Tematem drugiego rozdziału jest analiza przesłanek pozytywnych zwrotu wywłaszczonej nieruchomości, w tym zbędność nieruchomości na cel wywłaszczenia, zgoda poprzedniego właściciela na zwrot wywłaszczonej nieruchomości, zawiadomienie o zamiarze użycia nieruchomości na cel inny niż określony w decyzji wywłaszczeniowej oraz obowiązek zwrotu odszkodowania za wywłaszczenie. W trzecim rozdziale autorka pracy analizuje przesłanki negatywne zwrotu wywłaszczonej nieruchomości, w szczególności zagadnienie praw osób trzecich do nieruchomości wywłaszczonej.

The thesis focuses mainly on the subject of legal premises that render the restitution of expropriated property possible. The first chapter covers the issue of the 'expropriated property' and its scope in order to establish the catalog of expropriated real properties that may be the subject of the restitution.The subject of the second chapter are the legal conditions that must occur in order to render the restitution claim possible, such as the redundancy of the expropriated real estate for the public purpose, the approval for the restitution of the previous owner, the notification of the planned change in use of the property and the obligation of return of the indemnification. The third chapter focuses on the legal premises whose occurrence renders the return claim null and void, especially the third party's rights towards the expropriated real estate.
