The legacy per vindicationem as a form of testamentary disposition

Celem niniejszej pracy jest omówienie instytucji zapisu windykacyjnego wprowadzonego do polskiego porządku prawnego ustawą zmieniającą Kodeks Cywilny z dnia 18 marca 2011 r. (Dz. U. z 2011r. Nr. 85, poz. 458). Praca składa się z trzech rozdziałów. Najpierw poddano analizie konstrukcję prawną tej instytucji, przyczyny jej wprowadzenia oraz zdolność do bycia zapisobiercą, ustalenie przedmiotu zapisu windykacyjnego czy jego bezskuteczność. W kolejnym poruszono kwestię prawną zapisobiercy – proces spadkobrania, prawa legatariusza oraz jego odpowiedzialność za długi czy obciążenie podwójnym zapisem. Ostatni rozdział opisuje rozważania dotyczące ryzyka nadużyć w związku z tą instytucją.

The purpose of this thesis is to discuss the institution of legacy per vindicationem which was introduced into the Polish law by Act which was changing the Civil Code on 18th March, 2011 (Dz. U. z 2011r. Nr. 85, poz. 458). The text consist of three chapters. The first of them contains an analysis of the legal structure of the institution, the reasons for its introduction, the ability to be a legatee, determination of the subject and ineffectiveness of legacy per vindicationem. The next chapter was adressed to the legal status of the legatee – the process of inheritance, the rights of the legatee and his liability for debts.The last chapter describes the considerations regarding the risk of fraud in relation to this institution.
