The political position of the Council of Ministers in Poland

Praca magisterska przedstawia pozycję ustrojową jednego z konstytucyjnych organów władzy wykonawczej, jakim jest Rada Ministrów. Jest to organ, który stanowi bardzo ważny człon systemu organów państwa wpisujący się w konstytucyjną zasadę trójpodziału władzy. Konstytucja Rzeczypospolitej Polskiej z 1997 roku ustanawia Radę Ministrów częścią egzekutywy, nadając jej przy tym szereg istotnych kompetencji do prowadzenia polityki państwa i kierowania administracją rządową. Praca składa się z trzech rozdziałów, w których omówione zostały najważniejsze kwestie związane z działalnością tego organu. Rozdział pierwszy poświęcony został prawnemu usytuowaniu Rady Ministrów w strukturze władz państwa. Przedstawia charakterystykę systemu parlamentarno-gabinetowego oraz przedstawia Radę Ministrów jako organ władzy wykonawczej. Rozdział drugi opisuje procedurę powoływania i dymisji rządu, a także zmian w jego składzie. Ponadto, w rozdziale drugim przedstawiony został składy podstawowy i fakultatywny polskiego rządu oraz jego struktura wewnętrzna - organy wewnętrzne i pomocnicze. Ostatni rozdział mojej pracy porusza kwestie funkcji Rady Ministrów, ogólnych zasad organizacji pracy i trybu funkcjonowania Rady Ministrów, odpowiedzialności Rady Ministrów i jej członków, prawotwórczej roli rządu oraz trybu pracy Rady Ministrów.

The master thesis shows the position of the political system of one of the constitutional organs of executive power, which is the Council of Ministers. It is a body which is a very important member of the system of state bodies blending in with the constitutional principle of separation of powers. Polish Constitution of 1997 establishes a Council of Ministers as a part of the executive, giving its at the same time a number of important competencies to conduct state policy and directing government administration. My work consists of three chapters, in which have been discussed key issues related to the activities of that body. The first chapter was devoted to the legal location of the Prime Minister in the structure of state authorities. It shows the characteristics of a parliamentary-cabinet system and presents the Council of Ministers as an organ of executive power. The second chapter describes the procedure for the appointment and resignation of the government, as well as the changes in its composition. In addition, in the second chapter was presented basic and optional compositions of Polish government and its internal structure - internal organs and subsidiary ones. The last chapter of my work refers to the issues of function of the Council of Ministers, the general principles of organization of work and mode of functioning of the Council of Ministers, the responsibility of the Council of Ministers and its members, law-making role of the government and the Council of Ministers mode.
