A few words about the interpretation of law in accordance with the Constitution from the perspective of the derivative concept of legal interpretation

Niniejszy tekst stanowi zarys problematyki ujęcia wykładni prawa w zgodzie z konstytucją oraz wykładni zorientowanej na konstytucję w ramach procesu interpretacyjnego według koncepcji derywacyjnej. Autor poddaje pod rozwagę szereg problemów z jednej strony ukazując możliwości jakie daje przyjęcie derywacyjnej koncepcji wykładni przepisów prawa, a z drugiej zaznaczając trudności i kontrowersje związane z ustaleniem efektywności oraz dyskusyjnych optymalnych granic każdorazowego włączania norm konstytucyjnych w proces interpretacji i stosowania prawa.

This text outlines of the issue of interpreting the law in accordance with the constitution as part of the interpretive process according to the derivative concept. The author puts several problems into consideration. On one hand the author describes the possibilities offered by adopting a derivative concept of the interpretation of legal provisions, and on the other, he highlights the difficulties and controversies associated with setting efficiency and debatable optimal limits for the inclusion of constitutional norms in the process of interpretation and application of law.
