Does the principle of proportionality exist in the Polish civil procedure? : some remarks on the selected changes in the Code of Civil Procedure introduced by the Act of 4.7.2019 amending the Act - Code of Civil Procedure and certain other acts (Journal of Laws of 2019, item 1469) in the light of the ELI/UNIDROIT Model European Rules of Civil Procedure of 2020

Artykuł stanowi próbę odpowiedzi na pytanie o zasadność potraktowania zasady proporcjonalności w znaczeniu przyjętym w ramach Modelowych Europejskich Reguł Postępowania Cywilnego za angielskimi Regułami Postępowania Cywilnego jako naczelnej zasady procesowej na gruncie polskiego Kodeksu postępowania cywilnego w ujęciu de lege lata i de lege ferenda. W tym celu, poza wyjaśnieniem istoty tej zasady, autor dokonuje analizy szeregu zmian dokonanych na mocy ustawy z 4.07.2019 r. o zmianie ustawy Kodeks postępowania cywilnego oraz niektórych innych ustaw, które w jego ocenie pozwalają uchwycić dominujące tendencje rozwojowe odnośnie do badanej kwestii.

This article attempts at answering the question whether the principle of proportionality in the meaning adopted under the Model European Rules of Civil Procedure, following the English Rules of Civil Procedure may be deemed as the guiding procedural principle under the Polish Code of Civil Procedure both de lege lata and de lege ferenda. For this purpose, in addition to explaining the essence of this principle, the author analyzes a number of changes made under the Act of 4 July 2019 amending the Act – Code of Civil Procedure and certain other acts, which, in his opinion, allow to capture the dominant developments regarding the issue in question.
