Niniejsza praca magisterska przedstawia problematykę Ustawy Zasadniczej Republiki Federalnej Niemiec w aspekcie historycznym, społecznym i prawnym. Opracowanie podkreśla znaczenie niemieckiej konstytucji, której celowo nadano brzmienie ustawa zasadnicza, co miało stanowić o jej tymczasowości. Praca ukazuje tradycje konstytucjonalizmu niemieckiego, zagadnienia konstytucyjne i ustrojowe państwa, w tym regulację praw zasadniczych i ich ochronę w Ustawie Zasadniczej RFN. Jednym z zasadniczych celów pracy, było ukazanie oddziaływania ustawy zasadniczej na oblicze niemieckiego patryiotyzmu konstytucyjnego. Duża część pracy została również poświęcona działalności orzeczniczej Federalnego Trybunału Konstytucyjnego i jego roli jako ,, strażnika konstytucji" w przestrzeganiu prawa. Wielokrotnie odowoływano się w pracy do tradycji, mającej niemieckie korzenie zasady państwa prawnego. Zagadnieniem ubocznym w pracy jest przenikanie niemieckich rozwiązań ustrojowych na polski system polityczny.

This master's thesis shows issues of the constitution of the Federal Republic of Germany in the historical, public and legal aspect. The study is emphasized the significance of the German constitution which was deliberately named Grundgesetz because it was supposed to be temporary. The work shows traditions of the German constitutionalism, constitutional and political matters of state, in it the settlement of fundamental laws and their protection in the constitution Germany. One of the crucial objectives aims of work, was presenting the influence of the Grundgesetz on the face of the German was constitutional patriotism A large proportion of the work was also devoted to activity of the Federal Constitutional Tribunal and his role as,, of guard of the constitution""in the observance of the law. Repeatedly they were referring at the work to the tradition, having German roots of the principle of the legal state. At the work a permeation of German political solutions is an incidental issue to the Polish political system.
