Boycott call as an act of unfair competition

Jedną z postaci czynu nieuczciwej konkurencji polegającego na utrudnianiu dostępu do rynku jest nawoływanie do bojkotu. Nie każde takie działanie powinno być jednak zakazane. Autor analizuje ogólne przesłanki odpowiedzialności z art. 3 u.z.n.k., czyn polegający na utrudnianiu dostępu do rynku i jego szczególną formę z art. 15 ust. 1 pkt 2 u.z.n.k. oraz formułuje propozycje rozstrzygania konfliktów pomiędzy ww. przepisem a prawami podstawowymi. Artykuł omawia też wyroki polskich sądów w sprawie bojkotu producenta piwa.

A call for a boycott constitutes one of the forms of an act of unfair competition through obstructing market access. However, not all boycott calls should be prohibited. Author analyzes the general terms of liability of Art. 3 ACUC, the act of obstructing access to the market and its specific form as defined in Art. 15 sec. 1 pt 2 ACUC and formulates a proposal for resolving the conflicts between above-metioned regulation and fundamental rights. The paper also discusses the rulings of Polish courts on boycott of a beer producer.
