Evaluation of the reform of the National Revenue Administration – transformation and termination of service and employment relationships of officers and employees

Celem niniejszej pracy licencjackiej jest ocena reformy Krajowej Administracji Skarbowej (KAS) w kontekście przekształcenia i wygaszenia stosunków służbowych oraz stosunków pracy funkcjonariuszy i pracowników. Reforma KAS, wdrożona w 2017 roku, miała na celu zwiększenie efektywności i skuteczności działania administracji skarbowej w Polsce poprzez integrację dotychczasowych struktur administracji podatkowej, kontroli skarbowej oraz Służby Celnej. W pracy przeanalizowano zarówno formalno-prawne aspekty reformy oraz jej skutki dla funkcjonariuszy i pracowników.Praca zawiera rozdziały poświęcone funkcjonowaniu administracji danin publicznych przed wprowadzeniem Krajowej Administracji Skarbowej, analizie zmian wprowadzonych przez reformę, ocenie jej skutków dla funkcjonariuszy i pracowników oraz propozycjom rozwiązań na przyszłość. Metodologia badawcza obejmuje analizę aktów prawnych, dokumentów rządowych oraz literatury fachowej, a także wypowiedzi osób związanych ze strukturami KAS. Przeprowadzona przeze mnie analiza wskazuje, że proces przekształcania stosunków służbowych i pracy napotkał liczne wyzwania, w tym opór pracowników, problemy komunikacyjne oraz trudności związane z adaptacją do nowych struktur organizacyjnych. Wnioski z pracy sugerują konieczność dalszych prac dotyczących reformy KAS i wdrożenia nowych rozwiązań.

The aim of this bachelor's thesis is to assess the reform of the National Revenue Administration (NRA) in terms of transforming and phasing out the service and employment relationships of officers and employees. The NRA reform, implemented in 2017, aimed to enhance the efficiency and effectiveness of revenue administration in Poland by integrating the existing structures of tax administration, fiscal control, and Customs Service. The thesis analyzes both the formal-legal aspects of the reform and its implications for officers and employees.The thesis includes chapters dedicated to the functioning of public revenue administration before the introduction of the National Revenue Administration, an analysis of the changes introduced by the reform, an evaluation of its effects on officers and employees, and proposals for future solutions. The research methodology involves analyzing legal acts, government documents, and specialized literature, as well as statements from individuals associated with the NRA structures.The analysis conducted by me indicates that the process of transforming service and employment relationships encountered numerous challenges, including employee resistance, communication problems, and difficulties related to adapting to new organizational structures. The conclusions from the study suggest the need for further work on the NRA reform and the implementation of new solutions.
