Process and material deficiencies in building permits in the light of case law

Prezentowana praca przedstawia błędy procesowe i materialne podczas wydania pozwolenia na budowę. Przedstawione przykłady zostały poparte orzecznictwem. Temat został rozwinięty poprzez opisanie w pierwszej części ogólnej definicji pozwolenia na budowę, warunków jego udzielenia oraz przedstawienie inwestycji dla których nie wymagane jest uzyskanie pozwolenia budowlanego. Pozostałe dwa rozdziały skupiają się na uchybieniach procesowych oraz materialnych powstałych w trakcie postępowania o wydanie pozwolenia na budowę. Celem pracy jest teoretyczne opisanie instytucji pozwolenia na budowę oraz zaprezentowanie najczęściej popełnianych błędów materialnych i procesowych.

The presented work presents procedural and material errors during the issuing of a building permit. The examples presented have been supported by case law. The topic was developed by describing in the first part of the general definition of a building permit, the conditions for its granting and presenting investments for which a building permit is not required. The other two chapters focus on procedural and material shortcomings arising during the construction permit procedure. The purpose of the work is to theoretically describe the building permit institution and to present the most common material and procedural errors.
