The death penalty in Poland in selected penal regulations of the 20th century

Celem niniejszej pracy jest kompleksowe przedstawienie problematyki kary śmierci w Polsce w oparciu o regulacje prawnokarne XX wieku. W pracy omówiono genezę kary śmierci i przedstawiono, jak ta zmieniała się na przestrzeni lat. Scharakteryzowane zostały akty prawa karnego, które obowiązywały na ziemiach polskich podczas zaborów, szczególny nacisk położono na instytucję kary śmierci. Następnie opisano polską drogę do niepodległości oraz prace Komisji Kodyfikacyjnej, która zajmowała się m.in unifikacją prawa karnego. Scharakteryzowano kodeks karny z 1932 r., przedstawiono poglądy jego autorów oraz opisano czyny zabronione, które zagrożone były karą śmierci. Kolejno skupiono się na okresie Polskiej Republiki Ludowej, przedstawiono zagadnienia związane z małym kodeksem karnym, a także opisano, jak wyglądały prace nad kodeksem karnym z 1969 r. Kodeks Andrejewa został scharakteryzowany, opisano także typy czynów zabronionych, za które można było wymierzyć karę śmierci. W pracy skupiono się także na transformacji ustrojowej i tzw. okresie przejściowym, krótko przedstawiono obecny stan prawny i to, jak obecnie wygląda kara śmierci na świecie.

The aim of this paper is to provide a comprehensive description of the problem of the death penalty in Poland on the basis of the criminal legislation of the 20th century. The paper deals with the emergence of the death penalty and shows how it has changed over the years. The acts of criminal law applicable in the Polish territories during the conquests were characterized, special emphasis was placed on the institution of the death penalty. It then describes Poland’s path to independence and the work of the Codification Commission, which was concerned, among other things, with the unification of criminal law. It described the Criminal Code of 1932, set out the views of its authors and described the crimes for which the death penalty was imposed. One after the other, the emphasis was placed on the period of the Polish People’s Republic, on issues related to the Small Criminal Code, on the work on the Criminal Code of 1969, on the characterization of the Andreyev Code and on the types of crimes for which the death penalty could be imposed. The paper also focused on the transition process and the so-called transition period in order to provide a brief overview of the current legal situation and how the death penalty currently looks in the world.
