Utility easement in the Polish law.

Służebność przesyłu jako nowa instytucja ograniczonego prawa rzeczowego wprowadzona została do polskiego obrotu prawnego z dniem 3 sierpnia 2008 r. Służebność ta polega na obciążeniu nieruchomości na rzecz przedsiębiorcy prawem polegającym na tym, że może on korzystać w oznaczonym zakresie z nieruchomości zgodnie z przeznaczeniem urządzeń, o których mowa w art. 49 § 1 KC. Urządzenia te służą do doprowadzania lub odprowadzania płynów, pary, gazu, energii elektrycznej, z uwzględnieniem urządzeń podobnych. W pracy przedstawione zostały najważniejsze aspekty dotyczące służebności przesyłu, między innymi jej funkcja na tle służebności gruntowych, podmioty i przedmioty tej instytucji, treści oraz możliwości powstania i wygaśnięcia. Celem pracy jest omówienie aktualnie obowiązujących przepisów dotyczących tej instytucji, literatury oraz dostępnego orzecznictwa.

Utility easement constitutes a limited property right that was introduced to the Polish legal system on 3rd August 2008. The easement means that a real estate is encumbered for the benefit of the entrepreneur and it allows him to use the real estate within a defined scope to use the equipment defined in art. 49 § 1 of the Civil Code for the intended purpose. The equipment serves to transfer energy, gas and other substances. The regulation also takes into consideration other similiar equipment that is not specifically defined. In the thesis the most important aspects of utility easement were presented and discussed, among others its function in the context of land easement, its subjects and objects, the content and possibilities of establishing and expiry of this limited property right. The aim of the thesis is presenting current regulations, literature and jurisdiction regarding this institution.
