The issue of administrative sanctions

Celem niniejszej pracy magisterskiej jest zaprezentowanie kluczowych zagadnień związanych w wymierzaniem odpowiedzialności administracyjnej, a zasadniczo – sankcji administracyjnych. Całość moich rozważań podzieliłam na cztery rozdziały. W pierwszym dokonuję omówienia zagadnień wprowadzających, niezbędnych do właściwego umiejscowienia sankcji administracyjnych w strukturze wypowiedzi normatywnej i odpowiedzialności prawnej in genere. W kolejnym rozdziale omówiłam charakter prawny sankcji administracyjnej – począwszy od etymologii samego słowa „sankcja” poprzez określenie jej istoty i cech, a skończywszy na funkcjach poszczególnych jej rodzajów. Następnie przeanalizowałam najważniejsze aspekty związane ze stosowaniem sankcji, w tym: sposoby ich określania, możliwość stosowania uznania administracyjnego w procedurze ich wymierzania, podmiot podlegający ukaraniu oraz okoliczności wyłączające karalność i wpływające na wymiar kary. W opracowaniu znalazła się także analiza postępowania w przedmiocie wymierzania sankcji, rodzajów zapadających orzeczeń oraz etapu ich wykonywania. Na zakończenie, starałam się przybliżyć treść najważniejszych orzeczeń Trybunału Konstytucyjnego, w których podejmowano tematykę konstytucyjności regulacji sankcji administracyjnych.

The purpose of this master thesis is to present the key issues in regards to administration of administrative responsibility and in principle - the administrative sanctions. My reflections are divided into four parts. The first chapter is focused on introductory issues that are necessary for proper placement of the administrative sanctions in the structure of the normative speech and legal responsibility in genere. The second chapter concerns the legal concept of an administrative sanction – starting from the etymology of the word "sanction" by specifying its nature and characteristics and ending with a description of the functions assigned to each type of sanction. In the following part the subject of analysis were the most important aspects related to the application of sanctions, including: methods of determining, the possibility of using the administrative discretion during the execution of the sanction, entity subject to punishment and the circumstances excluding criminality and affecting punishment. The thesis also include a study of the procedure of administration of the sanction, types of decisions and their execution phase. The last chapter deals with the content of the most important decisions of the Polish Constitutional Court, taken in regards to the subject of constitutionality of regulations of the administrative sanctions .
