The newly established states and the situation of Crimea. Analysis of the Crimean problem under international public law.

Praca podejmuje zagadnienie kryzysu politycznego, zapoczątkowanego w lutym 2014 roku na Półwyspie Krymskim na Ukrainie, będącego efektem Euromajdanu - rewolucji w tym państwie. Problem ten przyrównany zostaje procesom tworzenia się nowych państw, ze względu na jedno z możliwych rozwiązań całego konfliktu, którym może zostać utworzenie kraju na spornym terytorium. Sytuacja na Krymie od samego początku stanowi ważny element współczesnych stosunków międzynarodowych, ponieważ jej efekty mogą w znacznym stopniu odbić się na krajobrazie politycznym Europy. Celem pracy jest zaprezentowanie procesu powstawania nowego państwa oraz jego relacji do sytuacji na Krymie.Pierwszy rozdział pracy skupia się na zagadnieniach wprowadzających w problematykę powstawania państwa. Rozpoczynając od zagadnień doktrynalnych dotyczących pochodzenia państwa, przechodząc przez przedstawienie pierwszych historycznie państw oraz kończąc na zobrazowaniu procesu powstania najnowszych na świecie krajów.Drugi rozdział pracy poświęcony został przedstawieniu zagadnień uznania międzynarodowego oraz podmiotowości w prawie międzynarodowym publicznym.Trzeci rozdział skupia się konkretnie na problemach dotyczących Krymu. Informacje wprowadzające w historię konfliktu oraz stanowiska obu stron zostały zamieszczone w pierwszym podrozdziale. Następne dwie części pozostawione zostały analizie argumentów Ukrainy i Rosji dotyczących sytuacji na spornym terytorium.Metodą badań wykorzystaną w pracy jest analiza i krytyka literatury przedmiotu.Analiza ta wykazała prawidłowość argumentów podnoszonych przez stronę ukraińską oraz błędne rozumowanie ze strony rosyjskiej.

The dissertation takes the issue of the political crisis that began in February 2014 on the Crimean peninsula in Ukraine, which is the result of Euromaidan - the revolution that took place in that country. This problem is compared to processes of formation of new states, because of one of the possible solutions to the conflict, which may be the creation of a country on the disputed territory. The situation in the Crimea from the very beginning, is an important part of contemporary international relations as its effects could greatly affect the political landscape of Europe. The aim of the dissertation is to present the process of creation of a new state and its relation to the situation in Crimea.The first chapter of the dissertation focuses on informations about formation of the state. Starting with doctrinal issues concerning the origin of the country, passing to the presentation of the historically earliest countries and ending with showing of the processes of the creation of the world's newest countries.The second chapter of the dissertation is devoted to the issues of international recognition and subjects of public international law.The third chapter focuses specifically on issues relating to the Crimea. Informations introducing the history of the conflict and the position of the two sides were included in the first section. The next two parts have been left to analyzing the arguments of Ukraine and Russia on the situation in the disputed territory.Research procedure used in this dissertation was to analyze and critique subject's literature.This analysis proved the correctness of the arguments raised by the Ukrainian side and the fallacy from the Russian side.
