Przedmiotem pracy jest analiza porównawcza modeli odpowiedzialności karnej i odszkodowawczej pod kątem zastosowania testu warunku sine qua non. Autor dokonał wszechstronnej analizy orzecznictwa oraz dorobku doktryny prawa karnego i cywilnego w zakresie przesłanek materialnych obiektywnego przypisania skutku oraz sposobu ustalania ich zastosowania w postępowaniu sądowym. Właściwe rozważania są poprzedzone rozdziałem wstępnym, w którym przedstawione zostały podstawowe różnice terminologiczne dotyczące przyczynowości i obiektywnego przypisania skutku. Autor dokonał również podsumowania przeprowadzonej analizy oraz przedstawił postulaty de lege ferenda.

The subject matter of the thesis comprises an analysis of of models of criminal liability and liability for damages in regard to the but for test. The author has performed a thorough analysis of the jurisprudence and works of doctrine of criminal and civil law with regard to the material prerequisites of the objective attribution of the effect and how to determine their use in legal proceedings. The main considerations are preceded by an introductory chapter, covering the main terminological differences in regard to causation and the objective attrivution of the effect in criminal and civil law. The author summarises his analysis and introduces the de lege ferenda proposals.
