Municipal property

Celem pracy jest omówienie najważniejszych kwestii związanych z mieniem komunalnym, uregulowanych przede wszystkim w ustawie o samorządzie gminnym, ale również w szeregu innych aktów prawnych. Praca składa się z trzech rozdziałów. Pierwszy z nich to wprowadzenie do tematu. Został poświęcony zdefiniowaniu pojęcia mienia publicznego oraz jego kategorii. Rozróżniono w nim również pojęcie mienia od pojęcia majątku. Drugi rozdział zawiera charakterystykę mienia komunalnego. Omówiono w nim podmioty dysponujące mieniem komunalnym oraz ograniczenia swobody gospodarowania mieniem przez te podmioty. Opisano też sposoby nabywania mienia przez gminy. Trzeci rozdział stanowi analizę pojęć zarządu i gospodarowania mieniem. Przedstawiono także zasady zarządu mieniem gminy. Rozpatrzona została w nim również problematyka kompetencji oraz właściwości organów gminy do stanowienia zasad zarządu mieniem komunalnym. Końcowa część pracy zawiera podsumowanie i wnioski wyciągnięte z analizy omawianej problematyki.

The aim of the study is to discuss the most important issues related to municipal property, regulated primarily in the Act on Municipal Self-Government, but also in a number of other legal acts. The work consists of three chapters. The first is an introduction to the topic. It was devoted to defining the concept of public property and its category. It also distinguishes the concept of property from the concept of assets. The second chapter describes the characteristics of communal property. It discusses entities that have municipal property and restrictions on the freedom of property management by these entities. The ways of acquiring property by communes were also described. The third chapter analyzes the concepts of property management and management. The rules of managing commune property were also presented. It also considers the issues of competences and properties of the commune authorities to establish the rules for the management of municipal property. The final part of the work contains a summary and conclusions drawn from the analysis of the discussed issues.
