Celem niniejszej pracy jest analiza wpływu sztucznej inteligencji na współczesną twórczość artystyczną, szczególnie w obszarze sztuk wizualnych. Omawia pojęcia autorstwa oraz prawach autorskich w kontekście dzieł generowanych przez SI. Kluczowym problemem badawczym było ustalenie, w jaki sposób SI zmienia proces twórczy i kto w świetle prawa może być uznawany za twórcę takich dzieł.Praca omawia wpływ sztucznej inteligencji na sztuki wizualne, analizując definicje SI oraz przedstawiając historyczny rozwój SI, w tym systemy ekspertowe, teorię gramatyk generatywnych Noama Chomsky'ego, „Chiński pokój” Johna Searle’a oraz zimy SI. Omówiono także modele koneksjonistyczne, które imitują procesy poznawcze mózgu.Przeprowadzono analizę literatury, w tym prac z zakresu technologii SI, prawa autorskiego i teorii sztuki. Przeanalizowano również przypadki twórczości generowanej przez SI, takie jak projekty Google, OpenAI oraz kolektywu Obvious. Praca uwzględnia omówienie technologii takich jak Generative Adversarial Networks czy Neural Style Transfer, a także zastosowania NFT w sztuce cyfrowej.Wyniki badań wskazują, że SI zmienia sposób tworzenia sztuki, ale nie zastępuje w pełni ludzkiej kreatywności. Współpraca artystów z SI może prowadzić do nowych form wyrazu. Jednocześnie automatyzacja procesów twórczych stawia wyzwania związane z przypisywaniem autorstwa i ochroną prawną dzieł. Praca podkreśla konieczność wprowadzenia nowych ram prawnych i dalszych badań nad etycznymi oraz społecznymi skutkami wykorzystania SI w sztuce.
The aim of this thesis is to analyze the impact of artificial intelligence on contemporary artistic creation, particularly in the field of visual arts. It discusses the concepts of authorship and copyright in the context of AI-generated works. The main research question was to determine how AI changes the creative process and who, under the law, can be recognized as the author of such works.The thesis examines the influence of AI on visual arts by analyzing AI definitions and presenting its historical development, including expert systems, Noam Chomsky's theory of generative grammar, John Searle's “Chinese Room”, and the “AI winters”. It also discusses connectionist models that imitate cognitive processes of the brain.A literature review was conducted, including works on AI technology, copyright law, and art theory. The thesis also analyzed cases of AI-generated art, such as projects by Google, OpenAI, and the Obvious collective. It covers technologies like Generative Adversarial Networks (GANs) and Neural Style Transfer, as well as the use of NFTs in digital art.The findings suggest that AI changes the way art is created, but it does not fully replace human creativity. Collaboration between artists and AI may lead to new forms of expression. However, the automation of creative processes raises challenges related to authorship attribution and legal protection of works. The thesis emphasizes the need for new legal frameworks and further research on the ethical and social implications of AI in art.
