dc.abstract.enThe main thesis regards the issue of idea as an unprotected element of copyright law. This issue was considered on the basis of advertising industry, through the analysis of different components of marketing campaign such as posters and billboards, logos, slogans, fictional characters and music pieces. This thesis answers the questions of whether using other people’s ideas in advertising is entirely legal and ethical and to what extend authors are allowed to be inspired by existing works or cultural and historical resources. The theoretical chapter depicts to the reader definitions that are crucial for deeply understanding the issue of the thesis such as idea, advertising, marketing, but also it involves legal terminology of a piece [of work], personal interests and the scale of personal and property rights in advertising. The second chapter discusses the elements of advertising under copyright and possible ways to violate them. This discussion Is based on the terminology of brand, trademark, plagiarism and the theory of marketing including common tactics and advertising strategies. This chapter explains the issue of many authors in creating adverts, the border between plagiarism and inspiration and the idea in advertising as an act of unfair competition. However, the crucial aspect of this thesis is the analytical chapter, in which there are outlined advertising campaigns based on the same ideas. Each component of the advertising campaign is analyzed in terms of content and rhetorical device in the context of copyright infringement and violation of personal interests. The matter of posters and billboards was divided into three categories that are different in the scale of inspiration by someone else’s idea- using the same theme by brands form different sectors of industry, brands from the same industry and adverts that refer to a common theme from culture. Examples that adequately illustrate these praxes are posters and billboards of such brands as United Colours of Benneton, Durex, Mercedes, Toyota, Audi, PaddyPower, Mimosa Milk, Marithe & Francois Girbaud and ME bar. Whereas the idea for logotype was divided into two main aspects- color and main theme. In this thesis there are analyzed different cases that involved the same ideas for one of these two elements, on the examples of brands such as Aston Martin, Mini Cooper, Chrysler, Bentley, Coco Chanel, Gucci, and in case of color- Castorama, Praktiker, Ikea, Makro, Microsoft and Google. The next analyzed element of campaign is slogan in the context of using common schemes for creating universal slogans. The examples of such praxes is car industry, which refer n their slogan to one of these two categories- putting the product in the center of attention or referring to technology. The last depicted aspect of advertising campaign that are based in idea are fictional character and music piece. The thesis discusses the cases in which there have been lawsuits for copyright infringement of one of these two elements. These situations involve using piece of someone artistic output without the permission of the author on the example of jingle from Wiadomości or using such fictional characters as Genowefa Pigwa or Kobieta Pracująca in advertising. As a summary of the issue of using ideas as an act of plagiarism there is also an analysis of a case study- the parapharmaceuticals industry as an example of using universal schemes in advertising. It’s illustrated by analyzing two most popular advertising strategies for these kind of products- referring to pseudo role model and the tactics of “medicament- miracle”, which hyperbolizes the positive effects of the product on consumer’s life. The last aspect within this issue is using the same schemes in designing the package of product. All the examples used in the thesis are the adverts of the biggest producer of parapharmaceuticals on the polish market – Aflofarm.pl

Kwestia ta rozważona została na przykładzie przemysłu reklamowego, poprzez analizę kolejnych elementów kampanii reklamowej, takich jak utwór plastyczny, logotyp, slogan, utwór muzyczny i postać fikcyjna. Praca rozstrzyga czy korzystanie z cudzych pomysłów w reklamie jest w pełni zgodne z prawem autorskim i etyką, a także w jakim stopniu twórcy reklam mogą czerpać inspirację z istniejącej już twórczości oraz zasobów kultury, historii, tradycji. Rozdział teoretyczny przybliża czytelnikowi pojęcia niezbędne do pełnego zrozumienia poruszonej w pracy problematyki, takie jak idea, reklama, marketing, a także terminologię prawną utworu, dóbr osobistych oraz zakresu autorskich praw osobistych i majątkowych dla omawianego problemu. W drugim rozdziale omówione zostały elementy chronione reklamy oraz ich możliwości ich naruszeń. Podstawą do wspomnianych rozważań jest terminologia takich pojęć jak marka, znak towarowy czy plagiat, a także teoria marketingu w zakresie taktyk i strategii reklamowych. Rozdział ten wyjaśnia także problematykę wielości twórców przy kreacji reklamy, granicy pomiędzy plagiatem, a inspiracją oraz idei w kampanii reklamowej jako czynu nieuczciwej konkurencji.Jednak kluczową częścią pracy jest rozdział analityczny, poświęcony kampaniom reklamowym, w których zostały wykorzystane identyczne pomysły. Każdy z elementów strategii reklamowej jest przeanalizowany pod względem treściowym i retorycznym w kontekście naruszeń prawa autorskiego i dóbr osobistych. Kwestia utworu plastycznego została rozdzielona na trzy kategorie zróżnicowane pod względem stopnia zapożyczenia cudzego pomysłu, czyli wykorzystanie motywu przez marki różnych branży, przez marki w ramach jednej branży oraz odwołanie się do motywu obecnego w powszechnej kulturze. Jako przykłady takich praktyk omówione zostały plakaty i billboardy takich marek jak United Colours of Benneton, Durex, Mercedes, Toyota, Audi, PaddyPower, Mimosa Milk, Marithe & Francois Girbaud oraz ME bar. Pomysł na logo natomiast został podzielony na dwa główne elementy, czyli motyw i kolorystykę. W pracy przeanalizowane są przypadki podobnych logotypów pod względem jednego z wymienionych elementów na przykładzie takich firm jak Aston Martin, Mini Cooper, Chrysler, Bentley, Coco Chanel, Gucci, a w kwestii kolorystyki Castorama, Praktiker, Ikea, Makro, Microsoft oraz Google. Odnośnie kolejnego elementu kampanii, czyli sloganu, przeanalizowane zostały przypadki korzystania przez wiele firm z uniwersalnych schematów haseł. Przykładem takiej praktyki jest branża samochodowa, w której slogany odwołują się do jednej z dwóch kategorii – stawianie w centrum uwagi produktu oraz nacisk na technologię. Ostatnimi składowymi kampanii reklamowej opartymi na pomyśle są utwór muzyczny oraz postać fikcyjna. W pracy przytoczone zostały przypadki procesów sądowych na tle oskarżeń o plagiaty obu wymienionych elementów. Omówione są sytuacje wykorzystania bez zgody autora elementu twórczości, na przykładzie jingla Wiadomości, utworu Baśka w reklamie oraz postaci Genowefy Pigwy i Kobiety Pracującej w spotach telewizyjnych. Jako podsumowanie problematyki idei w kontekście plagiatu w reklamie, przeanalizowana została branża parafarmaceutyków jako przykład problemu stopnia oryginalności utworów reklamowych a wykorzystywania uniwersalnych schematów kampanii reklamowych.
