Guiding principles of the Entity

Przedmiotem niniejszego opracowania są zasady przewodnie statusu jednostki czyli zasada godności, wolności oraz równości. Poprzez przedstawienie ujęcia poszczególnych zasad w systemie ochrony praw i wolności człowieka ukazano ich pozycję na arenie prawa międzynarodowego oraz sposób w jaki pojmowane były przez myślicieli w poszczególnych epokach cywilizacyjnych. Zasady godności, wolności i równości ujęte są również w Polskiej Konstytucji z 1997 roku oraz niejednokrotnie były przedmiotem badań Polskiego Trybunału Konstytucyjnego. Stanowią podstawę całego systemu praw i wolności człowieka i obywatela, a co za tym idzie całego porządku prawnego. Przesłanki ich rozwoju nie leżą wyłącznie w teoretycznych koncepcjach, oraz realizacji w aktach prawa stanowionego lecz również zależne są od warunków społecznych, ekonomicznych i kulturowych oraz świadomości wszystkich ludzi.

The subject of this work covers the Guiding Principles of Entity which are such principles as principle of dignity, freedom and equality. By presenting the recognition of the specific principles in the system of protection of the Human Rights and Freedoms it has been shown their position in the arena of thinkers in different epochs of civilization. Principles of dignity, freedom and equality are included in the Polish Constitution of 1997, and in many cases they have been studied by Polish Constitutional Court. They form the basis for of the entire system of Rights and Freedoms of Man and Citizen, and thus the law. Premises for their development are not only the theoretical concepts, and the implementation of the acts of statutory law but also are dependent on the social, economic, and cultural conditions as well as on awareness of all people.
