Contractual division of the property of the joint spouses after the end of the system of common property

Przedmiotem niniejszego opracowania jest problematyka umownego podziału majątku wspólnego małżonków po ustaniu wspólności majątkowej. Możliwość zawarcia umowy regulującej podział majątku wspólnego wynika z art. 46 k.r.o. w zw. z art. 1037 § 1 k.c. Podziałem umownym może zostać objęty zarówno majątek objęty wspólnością ustawową - art. 46 k.r.o., jak i majątek objęty wspólnością umowną - art. 48 k.r.o. W pierwszym rozdziale pracy został omówiony ustrój wspólności majątkowej. Przedstawiono i omówiono skład majątków osobistych oraz majątku wspólnego. Poruszono także problematykę wspólności łącznej majątku wspólnego. Kolejne rozdziały poświęcone są elementom umowy o podział majątku wspólnego takim jak jej przedmiot, strony oraz treść i forma. Omówiono charakter prawny umowy oraz poruszono problematykę wad oświadczenia woli, a także rękojmi za wady fizyczne i prawne. W dalszej części opracowania zaprezentowano skutki podziału oraz jego wpływ na sytuację majątkową małżonków i odpowiedzialność za powstałe zobowiązania. W ostatnim rozdziale pracy została przedstawiona problematyka podziału majątku wspólnego po śmierci jednego z małżonków. Szczególną uwagę poświęcono problematyce kolejności zawierania umów o dział spadku i podział majątku wspólnego.

The subject of this thesis is the issue of the contractual division of the community property of the joint spouses after the end of the conjugal community. The possibility to conclude an agreement regulating the division of community property results from article 46 of the Family and Guardianship Code in conjunction from article 1037 § 1 of the Civil Code. The contractual division may cover both assets covered by the statutory community - article 46 of the Family and Guardianship Code, as well as property covered by a contractual joint - article 48 of the Family and Guardianship Code.In the first chapter of the thesis, the system of conjugal community was discussed. The composition of separate property and common property was presented and discussed. The issues of commonality of the common property were also discussed. The following chapters are devoted to the elements of the agreement on the division of common property, such as its subject matter, parties and content and form. The legal character of the contract was discussed and the issue of defects in the declaration of will was discussed, as well as the implied warranty for physical and legal defects. The further part of the study presents the effects of the division and its impact on the property situation of the spouses and the responsibility for the resulting liabilities. The last chapter of the work presents the problem of the division of common property after the death of one of the spouses. Particular attention was paid to the issue of the order of concluding contracts for the estate of the inheritance and division of community property.
