Consumer protection in the real estate market

Celem niniejszej pracy jest omówienie problematyki ochrony interesów konsumenta na rynku usług deweloperskich ze szczególnym uwzględnieniem ochrony konsumenta nabywającego lokal mieszkalny lub dom jednorodzinny od dewelopera. W pracy omówione zostały regulacje ogólne prawa konsumenckiego znajdujące zastosowanie do wszystkich umów zawieranych z udziałem konsumentów, jak również regulacje szczególne mające zastosowanie wyłącznie do umów zawieranych z konsumentami przez deweloperów. Analizę tematu rozpoczęto od przedstawienia pojęcia konsumenta i jego definicji na gruncie prawa polskiego. Następnie przeanalizowany został charakter prawny umowy deweloperskiej przed i po wejściu w życie ustawy o ochronie praw nabywcy lokalu mieszkalnego i domu jednorodzinnego. W dalszej części pracy omówione zostały obowiązki informacyjne dewelopera względem konsumenta oraz instrumenty ochrony środków finansowych nabywców – mieszkaniowy rachunek powierniczy, gwarancja bankowa i ubezpieczeniowa. Przedstawiono instytucję odstąpienia od umowy deweloperskiej oraz rękojmi za wady fizyczne nieruchomości. W pracy omówiono również zagadnienie niedozwolonych postanowień umownych oraz przeanalizowano najczęściej spotykane w umowach deweloperskich klauzule.

The main aim of this thesis is to discuss the issue of consumer protection in the real estate market with emphasis on consumers buying residential premises or detached houses from developer. The thesis discusses the general rules of consumer law, applicable to all contracts concluded with customers, as well as special regulations which apply only to contracts concluded between developers and consumers . The analysis of the topic began with the presentation of the concept of the consumer and its definition under Polish law. Afterwards, author analysed the legal nature of developer agreement before and after the enforcement of the Act on protection of the rights of the buyers of residential premises or detached houses. The next part of the thesis covers informative obligations of developers towards consumers as well as measures to protect consumer’s funds – housing trust account, bank guarantee and insurance guarantee. Furthermore, the rules of withdrawal from developer agreement and developer’s guarantee were clarified. In the final chapter the problem of abusive clauses in consumer contracts has been discussed.
