Prezentowana praca stanowi próbę przedstawienia mechanizmów funkcjonowania zasady słusznego odszkodowania za wywłaszczenie nieruchomości. Pracy został nadany taki układ, by najpierw zaprezentować istotę podstawowych pojęć takich jak pojęcie własności oraz pojęcie wywłaszczenia. Kolejno omówiono ideę i przesłanki stojące za ukształtowania się obowiązku odszkodowawczego w prawie cywilnym. Na koniec przedstawiono szczegółowo problem realizacji zasady słusznego odszkodowania na gruncie ustawodawstwa zwykłego.
The purpose of the thesis is an attempt to present the mechanisms of the principle of fair compensation for the expropriation of the property. Presented thesis describes the essence of basic concepts such as the concept of ownership and the concept of expropriation. It discusses the idea which stands behind the formation of the obligation for compensation in civil law. At the end of the thesis there is a detailed description of the problem of implementing the principle of legitimate compensation into legislation.
