Legal interest in lodging an appeal

W polskim prawie procesowym cywilnym pojęcie interesu prawnego we wniesieniu środka zaskarżenia i związane z nim pojęcie gravamen należą do kategorii najbardziej spornych zagadnień. Głównym celem mojej pracy jest zbadanie i opisanie wpływu tych przesłanek na możliwość wniesienia środka zaskarżenia. Rozdział wstępny mojej pracy prezentował będzie ogólne informacje na temat polskiego systemu środków zaskarżenia. Następnie przedstawię historyczne ujmowanie interesu prawnego w zaskarżeniu przez przedstawicieli orzecznictwa i doktryny. W trzecim rozdziale szczegółowo przeanalizuję związek pomiędzy interesem prawnym a prawem do wniesienia środka zaskarżenia. Ostatnie dwa rozdziały opisywały będą konsekwencje braku interesu prawnego w zaskarżeniu oraz wyjątki od konieczności jego wykazania.

In polish civil procedure law the term of legal interest in lodging an appeal and related to it gravamen are one of the most controversial issues. The main goal of my thesis is to examine those terms and describe their impact on the right of appeal. The first introductory chapter presents the general facts about polish appeal system. Then I outline the historical statements of judicature and members of legal doctrine about the legal interest in lodging an appeal. In third chapter I analyze in detail the connection between legal interest and the right of appeal. The last two chapters discuss the consequences of lack of legal interest in lodging an appeal and the exceptions to the obligation to demonstrate it.
