Decision of support for the implementation of a new investment as a state aid measure

Problematyka pracy magisterskiej dotyczy zagadnienia pomocy publicznej na rzecz realizacji nowych inwestycji w Polsce. W pracy podjęto próbę przedstawienia dostępnych dla przedsiębiorców instrumentów wsparcia, ze szczególnym uwzględnieniem nowego środka pomocy zwanego Decyzją o Wsparciu. Pierwsza część pracy koncentrowała się na przedstawieniu zagadnienia interwencji państwa w gospodarce oraz na materialnych i proceduralnych aspektach związanych z udzielaniem pomocy publicznej. Następnie opisano rolę nowych inwestycji i rodzaje środków wspierania działalności gospodarczej w Polsce w perspektywie historycznej. W ramach przedmiotowych rozważań szczególną uwagę zwrócono na problematykę funkcjonowania specjalnych stref ekonomicznych oraz na nowo wprowadzony do polskiego porządku prawnego mechanizm wsparcia określany nazwą Polska Strefa Inwestycji. W pracy przedstawiono również charakterystykę Decyzji o Wsparciu, stanowiącą podstawę uzyskania pomocy publicznej w formie pośredniej. W dalszej kolejności zaprezentowano szczegółowe zagadnienia związane ze zwolnieniem podatkowym wynikającym z omawianej decyzji, zademonstrowano przykładową kalkulację wielkości otrzymywanej pomocy oraz podjęto próbę odpowiedzi na pojawiające się w praktyce problemy i wątpliwości interpretacyjne. W ostatnim rozdziale pracy zwrócono uwagę na wyróżnione aspekty pomocy publicznej wiążące się z Decyzją o Wsparciu. Celem przeprowadzonych rozważań i analiz jest kompleksowe przedstawienie Decyzji o Wsparciu jako środka pomocy publicznej dostępnego dla przedsiębiorców w Polsce.

The subject of the master's thesis concerns the issue of state aid for the implementation of new investments in Poland. In the thesis an attempt was made to present available support instruments for entrepreneurs, with particular emphasis on a new aid measure called the Decision of Support. The first part of this thesis was focused on presenting the subject of state intervention in the market as well as material and procedural aspects related to the granting of state aid. Thereafter, the role of new investments was described along with types of measures to support economic activity in Poland from a historical perspective. Within the framework of the considerations in question, particular attention was given to the issue of the functioning of special economic zones and the newly introduced mechanism of support to the Polish legal system known as Polish Investment Zone. The paper also presents the characteristics of the Decision of Support constituting the basis for obtaining public aid in the indirect form. The detailed issues related to the tax exemption arising from the discussed decision were presented afterward along with demonstration of an example calculation of the amount of aid received and an attempt to answer the problems and interpretation doubts that arise in practice. The final chapter of the thesis focuses on selected aspects of state aid associated with Decision of Support. The purpose of the deliberations and analysis carried out in this thesis is to comprehensively present the Decision of Support as measure of aid available for entrepreneurs in Poland.
