Problems of a nationwide referendum in article 125 of the Constitution of the Republic of Poland

Celem pracy jest przedstawienie i ocena regulacji referendum ogólnokrajowego zawartego w art. 125 Konstytucji RP tj. w sprawach o szczególnym znaczeniu dla państwa. Rozważania niniejszej pracy rozpoczynają się od definicji demokracji bezpośredniej oraz ujęciu w jej formach instytucji referendum ogólnokrajowego. Kolejne rozdziały skupione są wokół regulacji tej formy referendum w polskim systemie prawa, począwszy od uregulowań historycznych sięgających I połowy XX w. a kończąc na obecnie obowiązujących uregulowaniach, które znalazły swoje miejsce w Konstytucji z 1997 r. Ostatni rozdział skupiony został wokół praktyki stosowania instytucji referendum w Polsce. W pracy wskazano niedociągnięcia obecnych regulacji oraz zawarto postulaty zmian obecnych unormowań.

This thesis aims to present and assess the regulation of the nationwide referendum contained in Article 125 of the Constitution of the Republic of Poland, i.e., in matters of particular importance to the state. The considerations of this work begin with the definition of direct democracy and inclusion in its forms as the institution of a nationwide referendum. Subsequent chapters focus on the regulation of this form of a referendum in the Polish legal system, starting from the historical regulations dating back to the first half of the twentieth century and ending with the currently binding regulations which have found their place in the Constitution of 1997. The last chapter focused on the practice of applying the institution of the referendum in Poland. The paper points out the shortcomings of the current regulations and proposes changes to the current norms.
