Consent of a Disposer/Possessor of a Legally Protected Interest to Sexual Intercourse or Other Sexual Acts in Light of the Amendment to the Penal Code of 28 June 2024

Przedmiotem niniejszej pracy magisterskiej jest kompleksowa analiza dogmatyczna instytucji zgody dysponenta oraz dzierżyciela dobra prawnego w kontekście przestępstw przeciwko wolności seksualnej, ze szczególnym uwzględnieniem zmian wprowadzonych nowelizacją Kodeksu karnego z dnia 28 czerwca 2024 roku. Reforma ta, która weszła w życie 13 lutego 2025 roku, została oparta na paradygmacie zgody „Tak znaczy Tak” (Yes means Yes), wynikającym m.in z Konwencji Stambulskiej. Celem pracy jest ocena możliwego wpływu tych zmian na orzecznictwo i dorobek doktryny oraz krytyczna weryfikacja spójności logicznej nowo ukształtowanych typów czynów zabronionych w perspektywie instytucji zgody dysponenta/dzierżyciela dobra prawnego.

The subject of this Master’s thesis is a comprehensive dogmatic analysis of the institution of consent of the disposer/possessor of a legally protected interest in the context of offenses against sexual freedom, with particular emphasis on the changes introduced by the amendment to the Criminal Code of June 28, 2024. This reform, which entered into force on February 13, 2025, was based on the "Yes means Yes" consent paradigm, arising, inter alia, from the Istanbul Convention. The objective of the thesis is to assess the potential impact of these changes on case law and legal doctrine, as well as to critically verify the logical consistency of the newly shaped statutory types of prohibited acts from the perspective of the institution of consent of the disposer/possessor of a legally protected interest.
