Appeal measures in the general administrative procedure

Głównym celem pracy jest przedstawienie i wyjaśnienie charakteru prawnego odwołania jako środka zaskarżenia w ogólnym postępowaniu administracyjnym. Dodatkowo została przedstawiona ogólna charakterystyka pozostałych środków zaskarżenia, jakimi są zażalenie oraz wniosek o ponowne rozpatrzenie sprawy. W pierwszej kolejności skupiam się na opisaniu kluczowego pojęcia, jakim jest „środek prawny” oraz wymieniam elementy składowe systemu weryfikacji dokonywanej w drodze administracyjnej. Rozdział drugi dotyczy określenia charakteru odwołania jako środka zaskarżenia w ogólnym postępowaniu administracyjnym. W trzecim rozdziale skupiam się na opisaniu przebiegu postępowania odwoławczego. Czwarty rozdział, stanowi ostatni z rozdziałów i dotyczy charakterystyki zażalenia jako zwyczajnego środka prawnego.

The objective of the thesis is to present and clarify the legal aspects of the appeal measures as a means of complaint in the general administrative procedure. In addition, the general characteristics of the other means of appeal, such as the letter of complaint and the request for a case review, have been presented. First of all, I focus on describing the key concept of an 'appeal measure' and identifying elements of the verification system in the process of administrative procedure. The second chapter deals with the determination of the nature of the appeal measure as a means of complaint in the general administrative procedure. The third chapter addresses the presentation of the appeal procedure process. The fourth and the last chapter covers the characteristics of the letter of complaint as an ordinary legal means of appeal in the general administrative procedure.
