Protection and care of the movable monument in Polish legal system. Selected issues.

Praca podejmuje problematykę ochrony i opieki sprawowanej nad zabytkami ruchomymi w polskim porządku prawnym. Zawiera krótki rys historyczny pierwszych polskich zbiorów dzieł sztuki. Analizuje definicje zabytku ruchomego począwszy od Dekretu Rady Regencyjnej z 1918 roku, do chwili obecnej. Praca porusza kwestie ochrony zabytku ruchomego ze szczególnym uwzględnieniem problematyki wywozu zabytku za granicę. Charakteryzuje status prawny dysponenta zabytku ukazując niekorzystny bilans obowiązków w stosunku do praw. Celem pracy jest wskazanie kontrowersji wynikających z niektórych zapisów ustawy i konieczność prac nad doskonaleniem prawa w tej dziedzinie.

This Master's thesis illustrates the issue of protection and care exercised over movable monuments in the Polish legal system. It mentions the brief history of the very first polish art collections. Furthermore, the evolution of defining of movable monuments from the Regency Council Act in 1918 to this day is explained. This work consists of analysis of the process of protecting the movable monuments with special mention of the issues connected with exporting said goods abroad. It characterizes the legal status of the art's trustee by showing the negative balance of responsibilities versus the prerogatives. The main aim of this work is to point out the controversy of certain provisions of the legal system and the need to work on improving the polish law in this area.
