Complaints, proposals and petitions as forms of social supervision of public administration

Niniejsza praca nosi tytuł „Skargi, wnioski i petycje jako formy społecznej kontroli administracji publicznej”. Jej problematyka porusza zagadnienia z zakresu prawa administracyjnego, postępowania administracyjnego i prawa konstytucyjnego. Dotyczy problematyki obywatelskiej kontroli nad działalnością administracji publicznej.Celem autora było przeanalizowanie prawnej regulacji trzech wybranych form sprawowania społecznej kontroli administracji publicznej. Analiza ta miała doprowadzić do sformułowania wniosków i postulatów dotyczących funkcjonowania tych instytucji w polskim systemie prawnym. Aby osiągnąć te cele autor korzystał z aktów prawnych, orzecznictwa sądowego oraz literatury przedmiotu. Zasadnicze znaczenie miało przeanalizowanie art. 63 Konstytucji Rzeczypospolitej Polskiej, działu VIII Kodeksu postępowania administracyjnego oraz ustawy o petycjach. Autor sięgnął także do Regulaminu Parlamentu Europejskiego. Analiza tych źródeł pozwoliła na sformułowanie wniosków, wśród których znalazł się postulat bardziej jednoznacznego uregulowania problematyki petycji w prawie polskim. Autor zauważa tez problem w niedostatecznym rozróżnieniu instytucji wniosków oraz petycji. Rozważa także kwestię ewentualnej rezygnacji z instytucji skarg i wniosków i wprowadzenia uniwersalnego pojęcia petycji. Zwraca uwagę na potrzebę zagwarantowania sądowej kontroli w przypadku braku odpowiedzi organów na kierowane do nich środki kontroli obywatelskiej.Jednym z problemów napotkanych przez autora był mały zasób dostępnego orzecznictwa dotyczącego kwestii petycji. Było to spowodowane stosunkowo krótkim czasem obowiązywania uchwalonej w 2014 r. ustawy o petycjach.

This master’s thesis is entitled "Complaints, proposals and petitions as forms of social supervision of public administration". Its problems concentrates on administrative law, administrative procedure and constitutional law. The main issue is a civic right to check state administrative bodies.The aim of the thesis was to analyze the legal regulation of three selected forms of social supervision of public administration. This analysis was to lead to the conclusions and postulates regarding the functioning of these institutions in the Polish legal system.To achieve these goals, the author used legal acts, judicial decisions and legal literature. It was essential to analyze article 63 of The Constitution of the Republic of Poland, Chapter VIII of the Code of Administrative Procedure and the Petitions Act. The author also referred to the European Parliament Rules of Procedure.The analysis of these sources led to, among which there was a postulate to more clearly regulate the issue of petitions in Polish law. The author also notices a problem in the insufficient distinction between the institution of proposals and petitions. He is also considering resignation of complaints and proposals and the introduction of a universal legal notion of petitions. He draws attention to the need to guarantee judicial control in the absence of the authorities' response to the civic supervision measures addressed to them.One of the problems encountered by the author was a small amount of available case law regarding the issue of petitions. This was due to the relatively short time of the Petitions Act passed in 2014.
