Transcription of civil status records in the light of social changes

Moja praca magisterska dotyczy problematyki aktów stanu cywilnego oraz głównych problemów, jakimi dotknięta jest ta gałąź administracji publicznej w związku z zachodzącymi przemianami społecznymi. W czterech rozdziałach mojej pracy przedstawiłem ogólne informacje dotyczące znaczenia i trybu rejestracji stanu cywilnego, ze szczególnym zwróceniem uwagi na szczególne tryby ich rejestracji, związane głównie z obrotem międzynarodowym. Dokładnie omówiłem instytucję transkrypcji zagranicznych aktów stanu cywilnego oraz przesłanki odmowy jej dokonania. Kwestie te miały istotne znaczenie z punktu widzenia zasadniczej części pracy, to jest omówienia problemów dotyczących ustalenia stanu cywilnego dzieci rodziców jednopłciowych, rejestracji w aktach stanu cywilnego małżeństw homoseksualnych oraz innych podobnych kwestii. Należały do nich zwłaszcza ustalenie pochodzenia dziecka poczętego w wyniku umowy o macierzyństwo zastępcze lub w wyniku zastosowania procedur medycznie wspomaganej prokreacji. Przedmiotowa analiza prezentowana jest zarówno w kontekście przepisów ustawy - Prawo o aktach stanu cywilnego i kodeksu rodzinnego i opiekuńczego, jak i właściwych regulacji dotyczących kwestii wzajemnego uznawania zagranicznych orzeczeń i decyzji oraz ustalania prawa właściwego.

My thesis covers the issues of civil status records and main problems that appear in this branch of public administration, given the ongoing social changes. In four chapters of my paper, I presented general information concerning the significance and procedures of civil registration, with particular interest taken in special procedures of said registration, concerning predominantly international relations. I thoroughly covered the institution of foreign civil records transcription, as well as condition upon which such transcription is denied. The said issues had an important significance for the main part of my thesis, i.e. describing the problems concerning the establishment of a civil status of children of same-sex couples, civil registration of same-sex marriages and other similar issues. They involved particularly the establishment of origins of a child conceived as a result of surrogacy contract or application of medically assisted reproduction.Given analysis is presented in the context of both the provisions of the Registry Office Records Act and the Family and Guardianship Code, as well as relevant provisions concerning the issues of mutual recognition of foreign judgements and decisions and determination of applicable law.
