Systemic obligation to ensure citizens' safety : analysis of article 5 media parte of the Constitution of the Republic of Poland

Prezentowany tekst stanowi wprowadzenie do problematyki ustrojowego obowiązku zapewnienia bezpieczeństwa przez państwo. Szczególnym punktem zainteresowania pracy jest statuowane w art. 5 KRP bezpieczeństwo obywateli jako zadanie Rzeczypospolitej Polskiej oraz jego relacja do praw i wolności. Istotnie – wobec podnoszonego w dyskusjach prymarnego znaczenia bezpieczeństwa, o którym świadczyć miałaby sekwencja wymienionych w analizowanym przepisie wartości – należy szczegółowo wyjaśnić zasady na jakich treść analizowanego przepisu Konstytucji RP oddziałuje na zasady ograniczania praw i wolności konstytucyjnych. Niniejszy artykuł jest próbą odpowiedzią na ten dylemat oraz wyrazem szeregu istotnych spostrzeżeń w zakresie znaczenia zadania państwa do zapewnienia bezpieczeństwa każdej istoty ludzkiej, a w omawianym kontekście przede wszystkim jego obywateli.

The presented text is an introduction to the problem of the systemic obligation to ensure security by the state. A particular point of interest in this work is the citizens' safety (which is set out in the article 5 of the Constitution of the Republic of Poland as a task of the Republic of Poland) and its relation to rights and freedoms. Indeed – in relation to the primary importance of security raised in the discussions, which is to be demonstrated by the sequence of values listed in the analyzed provision – it is necessary to explain in detail the manner in which the content of the analyzed provision of the Constitution of the Republic of Poland affects the principles of limiting constitutional rights and freedoms. This article is an attempt to respond to this dilemma and an expression of a number of important insights about the importance of tasks of the state to ensure the safety of every human being, and in this context, first of all its citizens.
