Principle of active participation of the parties in the administrative proceedings

Celem pracy jest zaprezentowanie kodeksowej zasady ogólnej czynnego udziału strony w postępowaniu administracyjnym. Praca obok analizy uprawnień strony wpływających na jej czynny udział w postępowaniu, zawiera również ocenę obowiązujących uregulowań kodeksowych. W pracy przedstawiona jest też rola organu administracyjnego prowadzącego postępowanie i mającego jednocześnie umożliwić stronie czynny udział w tym postępowaniu oraz praktyka polskich sądów administracyjnych. Czynny udział strony w postępowaniu nie jest zasadą bezwzględną, więc w pracy zawarte są również wyjątki od tej zasady, a także gwarancje jej stosowania.

The aim of the thesis is to present geeral rule - active participation of the party in the administrative proceedings. Besides the analysis of the party permissions, the thesis contains opinion about current code solutions. The thesis presents the role of the administrative body conducting the proceedings and enabling the party to participate actively in the proceedings. The thesis also presents practice of Polish administrative courts. The active participation of the parties in the administrative proceedings is not an absolute rule. The thesis contains exception to this rule and also guarantees of its implementation.
