Criminal law issues of vending, providing and consuming alcoholic drinks

Niniejsza praca ma na celu przedstawienie karnoprawnej problematyki napojów alkoholowych. Na samym początku wyjaśnione są podstawowe pojęcia takie jak: napój alkoholowych. Następnie analizie zostały poddane przepisy z ustawy o wychowaniu w trzeźwości i przeciwdziałaniu alkoholizmowi. Omówione są przypadki kiedy zakazane pod sankcją karną jest sprzedawanie, podawanie oraz spożywanie napojów alkoholowych. Praca zawiera również część historyczną, w której został przedstawiony rozwój instytucji prawnych dotyczących alkoholu. Na końcu każdego rozdziału znajdują się elementy komparatystyczne, a więc zostały omówione rozwiązania prawne dotyczące alkoholu, które obowiązują w innych krajach. Praca poddaje również analizie dane statystyczne dotyczące tzw. przestępstw alkoholowych, które zostały uzyskane od Policji w ramach dostępu do informacji publicznej.

The master’s thesis is focused on the issue of the alcoholic drinks in the light of criminal law. At the beginning of the paper basic concepts are explained such as: alcoholic drinks. Further on, there is an analysis of the regulations from The Act on Upbringing in Sobriety and Counteracting Alcoholism. This chapter deals with cases, in which vending, providing and consuming alcoholic drinks is forbidden. The paper also contains historical part, in which I introduced the historic development of legal solutions concerning alcoholic drinks. At the end of each chapter there are comparative elements, therefore it applies to regulations that are in force in other countries. Statistic data concerning so called “alcoholic crimes” are also analyzed in the present paper. They have been obtained from the Police within access to public information.
