The procedure for granting an enforcement clause to the writ of execution

Tematem niniejszej pracy jest postępowanie o nadanie tytułowi egzekucyjnemu klauzuli wykonalności. Przedmiotem pierwszego rozdziału są  zagadnienia ogólne związane z postępowaniem o nadanie klauzuli wykonalności, a w szczególności problematyka charakteru prawnego tego postępowania. W rozdziale drugim szczegółowo omówiono pojęcie i treść klauzuli wykonalności oraz rodzaje klauzul wykonalności.  Rozdział trzeci poświęcono analizie przebiegu postępowania o nadanie klauzuli wykonalności, z uwzględnieniem m.in takich kwestii jak treść wniosku o nadanie klauzuli, termin na jego rozpoznanie oraz właściwość i kognicja sądu. W rozdzialeczwartym znalazła się charakterystyka najważniejszych problemów występujących w postępowaniu o nadanie klauzuli wykonalności z wykazaniem przejścia uprawnień. Natomiast ostatni rozdział zawiera rozważania dotyczące dopuszczalności skargi na przewlekłość postępowania o nadanie klauzuli wykonalności.

The subject of this master's thesis is the procedure for granting an enforcement clause. The first chapter includes general issues related to the procedure for granting an enforcement clause, in particular the legal nature of this procedure. The second chapter discusses the concept and content of the enforceability clause in detail and types of enforcement clauses. The third chapter is devoted to an analysis of the course of the proceedings for granting an enforcement clause, taking into account, inter alia, such issues as the content of the application, the time limit for its examination and the jurisdiction of the court. The fourth Chapter is the description of the most important problems occurring in the proceedings for granting an enforcement clause with the transfer of powers and obligations. The last chapter contains reflection on the admissibility of a complaint against the length of proceedings for granting an enforcement clause.
